What does it say when employees allege inadequate security?

There have been several high-profile shootings in recent months. There was the open-air tragedy in Las Vegas. More recently, there was the high school shooting in Florida. Of course, New York is not immune from such incidents. Just under a year ago, there was the deadly shooting at Bronx-Lebanon Hospital.

One doctor died and five other employees were hurt, as was a patient. The immediate horror ended when the gunman took his own life. But as is evidenced by a recent lawsuit, the suffering is not over for everyone. One young doctor who was injured that day is now suing the hospital. He says lax security at the facility contributed to creating conditions that allowed the gunman – a former doctor – to be there that day.

Indeed, the doctor’s suit cites at least two areas of hospital fault. It says the administration’s background checks of the doctor were insufficient, failing to uncover red flags that might have prevented his being hired. The suit also alleges lapses in security allowed the gunman to retain his identification card – which he used to return on the day of the shooting.

Another named defendant in the suit is the Schenectady gun shop that sold the AR-15 rifle that the gunman used. The allegation is that the shop failed to conduct a mandated check of the man.

Besides being shot in the abdomen and requiring nearly a month’s worth of hospitalization, the plaintiff says that while he was in a coma for 10 days, no one notified his family. Finally, the first-year medical resident says his career has suffered because of the residency interruption and because of post traumatic emotional distress.
