$1.5 million settlement after jury selection an English couple visiting New York from England, who suffered 1st and 2nd degree burns, while showering together in their hotel, when the water suddenly and without warning, became scalding hot. The couple tried to escape injury but fell due to the pain. Both parties suffered blistering and were required to enter the Cornell Burn Unit and undergo excruciating physical, rehabilitative and occupation therapy, and needed to remain in New York for almost three additional weeks before returning home. Plaintiff’s expert found that the hotel had multiple deficiencies, including a defective boiler, unmarked faucets and a bathtub floor that had no required skid-resistance, and prevented the parties from exiting the shower before they suffered additional exposure to the boiling water.
