$850,000 awarded to a 44 year old woman who slipped and fell in the lobby of her Westchester County building. We argued that people entering the lobby from an indoor/outdoor garage had grimy feet that tracked dirt and water into said lobby, and the building didn’t place carpets in the vestibule to reduce slipperiness. We supported our theory by locating earlier photos and building tenants who corroborated that the floor was typically filthy and slippery. The plaintiff suffered a wrist injury involving cartilage tearing that required an arthroscopy. This surgery didn’t heal well and the plaintiff underwent an ulnocarpal ligament tightening and then required a surgery shorten her ulnar, so that it wouldn’t rub on her radius.
