$1.1 million settlement for a 68-year-old client who following a penile implant, developed an infection that required the implant to be removed, and necrotic tissue from the penis to also be removed. We argued that the injuries were caused because the doctor should never have approved the plaintiff as a candidate for surgery, due to prior medical conditions. We additionally argued that the failure to respond appropriately, following complaints of severe pain and an open wound, and didn’t prescribe strong enough antibiotics to kill the infection before it became problematic. The defense argue that the plaintiff had not followed medical advice, which was significant as he was a diabetic, and thus more prone to infection and gangrene.
