$350,000 Settlement for Exterminator Injured on the Job

$350,000 settlement against a New York City Hospital, for our client, a local exterminator injured on the job. The accident occurred in the winter of 2018 two days after a blizzard. The plaintiff was required to work, despite weather conditions, because when its cold outside, vermin such as rats or mice seek shelter in the various outdoor bait traps to stay warm. When he exited the building lobby to access traps in the courtyard, he was advised the courtyard was safe. In fact, it was left full of ice patches, causing the plaintiff to slip and fracture his right foot. The plaintiff was born with clubbed feet and required a big operation to repair the bones in his feet at the age of 1. This accident caused the bones that had been repaired to refracture and required extensive surgical repair with hardware. We proved the maintenance crew poorly cleaned the yard by procuring video feed from the superintendent’s apartment, and locating a file note by a porter stating the courtyard needed to be re-sanded several hours before the plaintiff fell.
