The husband, who had undergone back surgery 10 years earlier, with a rod installed, alleged that prior symptoms, such as weakness and pain reemerged post-accident. He also developed carpal tunnel syndrome. The wife had soft tissue injuries. The driver was arrested and prosecution begun, but the DA allowed him off with a misdemeanor and a fine.
