Fatal accident may warrant wrongful death claim in New York

High speed can often be a contributing factor in car crashes. When such an accident takes place, it is also not unusual for serious or fatal injuries to result. Unfortunately, individuals who were not driving are often the ones who end up suffering, and when fatalities occur, surviving families must find a way to come to terms with their sudden losses.

It was recently reported that a New York crash involved only one vehicle, and speed was believed to have been a factor. Apparently, the vehicle was going approximately 90 mph when the driver lost control, and the vehicle left the roadway. The car then crashed into a tree and overturned. There were two individuals inside the vehicle at the time. Their ages were reported as being 32 ad 28 years old.

Both individuals suffered fatal injuries in the accident. It was noted that they had been wearing seat belts. The report did not disclose which individual may have been driving at the time of the crash. Authorities were still investigating in order to determine what other factors may have led to this fatal incident in addition to excessive speed.

The family of the passenger killed in this accident has a right to pursue justice for their loss. Therefore, they may wish to consider filing a wrongful death claim against the estate of the deceased driver. This type of civil claim could allow them to work toward gaining compensation for funeral expenses, pain and suffering, and other damages permitted under New York law.
