Handle Each Case

A fall on someone else’s property can turn an ordinary day into months of pain, missed paychecks, and unbudgeted bills. Maybe you slipped on a wet floor at a Garden City store, tripped on a cracked sidewalk, or fell down stairs in an apartment building with no working handrail. Whatever caused it, the property owner or manager who let the hazard sit there may be responsible.
When these slips, trips, and falls happen, you need an experienced Garden City personal injury lawyer who understands what the law says and what it means for your claim.
A Garden City slip and fall lawyer at Sakkas, Cahn & Weiss can take on the insurance company for you. Attorney Adam D. Cahn, recognized by Best Lawyers since 2021 for personal injury litigation, has won a $7.4 million verdict for a woman who suffered a traumatic brain injury after a slip and fall caused by a building’s roof leak. Prior results do not guarantee a similar outcome.
That result comes from a real investigation, not a quick insurance offer. Reach out to talk through what happened and what it might be worth.

Adam D. Cahn’s slip and fall track record includes cases much like the one you may be facing now. He obtained a $7.4 million verdict for a woman who suffered a traumatic brain injury, cognitive damage, and ongoing emotional trauma after a building’s roof leak caused her to slip and fall.
In another case, he reached a $2.5 million mediation for a client who needed neck and back surgery after slipping on an unsalted icy sidewalk outside a retail drugstore. These results came from proving what the property owner knew, or should have known, about the hazard before the fall happened.
Prior results do not guarantee a similar outcome, but they show what thorough preparation can do for a client who trusted this firm with a claim.
We handle falls caused by hazards that property owners had a duty to fix or warn you about. That includes:
If your fall involved something not listed here, it may still qualify. We look at the property, the hazard, and the maintenance records to determine who is responsible.
A slip and fall injury can cost more than a hospital bill. Torn ligaments, herniated discs, and fractures often mean surgery, physical therapy, and months away from work. Property insurance companies know most people can’t afford to wait that out.
Under New York’s CPLR § 214, personal injury lawsuits generally must be started within three years, and once that window closes, the claim is gone for good no matter how strong the evidence was.
New York law also protects you if a property owner argues you were partly to blame: under CPLR § 1411, culpable conduct “shall not bar recovery, but the amount of damages otherwise recoverable shall be diminished in the proportion which the culpable conduct attributable to the claimant or decedent bears to the culpable conduct which caused the damages.” In other words, you can still recover, but your damages are reduced by the percentage of fault assigned to you.
If your case ends up in litigation, it will likely be heard at the Nassau County Supreme Court on Supreme Court Drive, the trial court that handles civil injury claims filed throughout this part of Long Island.
Falls on sidewalks, parks, or buildings owned by the Village of Garden City or Nassau County follow different rules than falls on private property. You typically must file a formal notice of claim within 90 days of the fall — well before the three-year deadline that applies to most private property cases. If you do end up suing the Village or County, that lawsuit generally has to be filed within one year and 90 days of the fall, not three years.
Garden City sidewalk falls carry one more hurdle: the Village generally isn’t responsible for a broken sidewalk unless it received written notice of that exact defect before you fell. This is called a “prior written notice” law, and it can be a real obstacle even when the sidewalk was clearly in bad shape. Because these deadlines and rules are easy to miss, contact a lawyer as soon as possible after a fall on public property.
Every case depends on your injuries, medical costs, lost income, and how clearly the property owner’s negligence caused your fall. We can give you a realistic range once we’ve reviewed your medical records and the property’s history of complaints or repairs.
Nothing upfront. We handle slip and fall cases on contingency, which means our fee comes out of your settlement or verdict, not your pocket. If we don’t recover money for you, you don’t owe us a legal fee. Your first consultation is also free.
Combined, the firm’s partners have practiced law in New York for decades. Matthew Sakkas was admitted to the New York State Bar in 1992, Adam D. Cahn in 1995, and Mitchel E. Weiss in 1986. Weiss’s original practice is one of two firms that combined to form Sakkas, Cahn & Weiss.
You don’t have to manage the medical bills, lost paychecks, and an insurance adjuster’s phone calls by yourself. A Garden City slip and fall attorney at Sakkas, Cahn & Weiss can start gathering surveillance video and maintenance records before they disappear, and we work on contingency, so you pay nothing upfront and owe no attorney’s fees unless we win.
